While a transfer to a trust is not a statutory badge of fraud, transfers to trusts have historically been viewed with particular suspicion in fraudulent transfer cases. This goes back at least as far as Twyne's Case in 1601, the classic fraudulent transfer case, where it was stated that "fraud is always apparelled and clad with a trust, and a trust is a cover of fraud."
