While a transfer to a trust is not a statutory badge of fraud, transfers to trusts have historically been viewed with particular suspicion in fraudulent transfer cases. This goes back at least as far as [[Maintwynescase|Twyne's Case]] in 1601, the classic fraudulent transfer case, where it was stated that "fraud is always apparelled and clad with a trust, and a trust is a cover of fraud."
